EB-5 REAUTHORIZED FOR 5 YEARS

The EB-5 program allows investors to obtain a green card if they invest $800,000 or $1,050,000 in businesses or projects that will create 10 full time jobs. 

 

On March 11, 2022, Congress passed the EB-5 Reform and Integrity Act of 2022, officially reauthorizing the EB-5 regional center program. The program has been reauthorized for 5 years, until September 30, 2027. [Program was previously suspended on June 30, 2021]

 

Changes to the regional center program due to reform act:

  • Min. Investment Amount - $800,000 for TEA [Targeted Employment Areas]
  • Non-TEA - $1,050,000
  • Investment amount prescribed above to remain constant for 5years
  • Consumer Price Index adjustment takes place every 5yrs
  • TEAs determined by DHS - Based on unemployment rate of 150% of the national average
  • Rural areas and Infrastructure projects do stand a chance to qualify*
  • All source of funds explanation is must [Investment, administrative, legal fees, USCIS fees]
  • Application submitted before June 30, 2021 will be restarted / processed 
  • I-526 can be submitted 60 days since re-authorization date 

 

Those already residing in the U.S and have a pending I-526 can now consider to file an [AOS] if respective country’s EB-5 Visa is current per recent visa bulletin.

 

New Form I-526 applicants can file a Form I-485 application to adjust status simultaneously with the Form I-526 application. 

 

The Form I-485 will be processed after the initial EB-5 application is approved.

This benefits applicants to stay in the USA while I-526 is pending and also allow apply for a W.P. Travel Permit along with [AOS]
